Key facts

  • 28 entities selected to participate
  • Football clubs and betting groups among speakers
  • Hearing covers provisional measure banning fixed-odds betting

Brazil betting ban hearing will be at the Supreme Federal Court on 3 November. Justice Luiz Fux has set the time and picked 28 groups for the meeting. The hearing will look at what happens when a rule bans fixed-odds betting and ends betting licences.

Participants and schedule for the hearing

The hearing starts at 10am in the Second Chamber of the Supreme Court. People can watch it live on TV, on Radio Justiça, or on YouTube. Each of the 28 groups can send two people. They had to give names by 3pm on the Thursday before the hearing.

Football clubs like Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo and Corinthians will speak. The Brazilian Football Confederation and the Brazilian Olympic Committee will also talk. The Attorney General’s Office, the Ministry of Finance, and the Ministry of Sports will speak after lunch.

Each group will have 10 minutes to share their views on the ban and the rule that ends betting licences.

Legal context and actions under review

The hearing is part of Direct Action of Unconstitutionality (ADI) 8027. Justice Fux is in charge of this case. The National Association of Games and Lotteries (ANJL) started the case. The ANJL wants the court to stop Provisional Measure 1,394/2026 right away.

The group also wants the court to say that current betting laws are valid. Other cases about the same rule are ADIs 8,024, 8,028 and 8,035. The Supreme Court is also looking at ADIs 7721, 7723 and 7749. These cases ask if Law 14.790/2023, called the Betting Law, is valid.

This law set the rules for fixed-odds betting in Brazil.

Sector groups, associations and previous hearings

Betting groups like the ANJL and the Brazilian Institute of Responsible Gaming (IBJR) will speak from 3pm to 3.20pm. Other groups include the National Confederation of Commerce, the National Confederation of Industry, and the Brazilian Association for Economic Freedom. The International Gaming Association will speak last, at about 5pm.

The Economic Regulation Laboratory of the State University of Rio de Janeiro and the Brazilian Association of Radio and Television Broadcasters are also on the list. In November 2024, the Supreme Court held a hearing on betting laws. More than 50 experts and officials came. The Attorney General’s Office asked for a new hearing.

They said new facts and the new rule mean the court should look at the issue again.
